Buying Georgian property remotely by power of attorney

Assign each task before a remote purchase: property review, signing, filing, payment and physical handover. Record the result and evidence you expect at every stage.

Representation and its scope

Articles 103–104 of the Civil Code permit a transaction through an agent. A transaction made within the agent’s authority and in the principal’s name creates rights and obligations for the principal. Prepare a draft power of attorney with the lawyer handling the registration, then confirm its acceptability with the receiving participants. Establish certification, country-of-issue, translation and original-document requirements before visiting a notary. The procedure for a document from your country needs its own confirmation; do not assume an apostille is universally required.

Powers to discuss in the draft

Identify the property or selection limits, maximum price, permitted agreement, amendment powers, filing and document collection. Decide separately whether the representative may receive funds, change bank details, delegate authority or accept the property. These are drafting questions, not a universal mandatory form.

Limit the instruction to the necessary actions and duration. Retain the approved text and translation version. A proposed change of price, property or beneficiary should return to review rather than informally expanding the instruction.

NAPR’s remote service and foreign passports

NAPR’s Smart Contract FAQ specifies that the service is available to Georgian citizens holding a valid Georgian ID card or passport. Control payment and document delivery

Agree transfers with the banks separately from property representation. Authority to act for an account holder and transaction review need their own confirmation; TBC, for example, publishes a banking-services power-of-attorney form. Before payment, match the final agreement, property, price, signatures and beneficiary details. After filing, obtain the application number and decision, then a current extract. Commission technical handover separately. Request continuous video, a defect list, meter readings, keys and photographs of relevant components. Distinguish a visit report from an acceptance document stating that the apartment has no outstanding defects.

Frequently asked questions

Is a scan of the power of attorney enough?

Agree the form, original, translation and filing route with the receiving party before issuing the document. Do not make payment based only on a forwarded sample form.

Will a property power of attorney work for the bank?
